for the sale of real estate

I. Subject of Sale

According to the land registry in the land registers of the Municipal Court in Pazin, Land Registry Department

Labin for cadastral plot 316636 Ripienda, the subject of sale is 2195/10000 of part cadastral plot no. 1778/3,
pasture with 1131 m2 registered in land registry office 944, and 2195/10000 part of land registry office 1778/4 pasture with
320 m2 registered in land registry office 973.
In essence, the subject of sale is an apartment with an estimated net usable area of ​​41.51 m2,
which is located on the first floor of a building built in 1977 on land registry office 1778/3 together with
2195/10000 of the co-ownership part of the building and the associated land, and 2195/10000 part
of land registry office 1778/4.
The apartment consists of a hallway, bathroom, kitchen and living room, bedroom, and two
covered and uncovered terraces. The apartment is in poor condition because it has not been regularly maintained,
and requires complete renovation.
The subject of sale is located in the settlement of Rabac, in the wider area of ​​the town of Labin. The distance of the parcel from the sea is approximately 1500 m. Parcel number 1778/3 has vehicular access to the public area via cadastral plot no. 1778/4, which is not owned by the seller. Possible access to parcel cadastral plot no. 1778/3 is via cadastral plot no. 1778/4, which is the subject of this tender. The parcel on which the building in which the apartment is located is approximately trapezoidal in shape. The building in which the apartment in question is located is a detached multi-apartment building with 6 functional units. The apartment that is the subject of sale is designated in the existing documentation as apartment (studio) number 5. The surrounding properties are residential and multi-apartment buildings of individual construction. II. Legal status
The land registry status of the subject of sale has not been arranged and does not correspond to the actual
state of development, ownership and possession:
The building built on cadastral plot no. 1778/3 is neither registered in the land registry nor in the cadastre.
The seller is not registered in the land registry as the owner, but the land is registered as pasture,
and the SOCIAL OWNERSHIP is registered and the right of use is registered in favor of:
MUNICIPAL COMPANY, REPUBLIC OF SLOVENIA, AJDOVŠČINA which entry is for cadastral plot no.
1778/3 pasture, area 1131 m2, land registry number 944 cadastral plot no. 316636 Ripenda executed under Z-436/77

of 17.06.1977, and for cadastral plot no. 1778/4 pasture, area 320 m2, z.k.ul. 973 hp 316636
Ripenda, under Z-759/80 dated August 1, 1980. Mr.
In relation to both parcels, there is still an entry from 07.26.1991. under Z-939/91: It is recorded
prohibition of disposal and encumbrance of real estate in A.I. part, according to the Decree on prohibition of disposal
real estate, on the territory of the Republic of Croatia, issued in N.N. 36, dated July 24, 1991.
In relation to both plots, entries under Z-1169/01 and Z-328/04 show that they were rejected
the attempts of Komunalno Stanovanjske Družba d.o.o. Ajdovšćina, and Gradbeno Obrtnoj Pojetje
Ajdovšćina d.d. in bankruptcy, for registration of ownership rights to both properties in the proportions
2195/10000 of the share and 7805/10000 of the share.
Actual state of construction, ownership and possession:
On cadastral plot no. 1778/3 there is a building which is not registered in the cadastre or in the land register. It was built on the basis of a Building Permit issued by the Municipality of Labin on
12.01.1977. No. 03-Up-I-78871976. in the name of KOMUNALNO PODJETJE, AJDOVŠČINA.
Approval for use of the building (resort) No. 03-UP-I-537/77 was issued on
23.09.1977. The seller has copies of the above documents.
Under Z- 436/77 and Z- 939/80 registered social ownership with the right of use for the benefit
COMMUNAL COMPANY, REPUBLIC OF SLOVENIA, AJDOVŠČINA dates back to the time
SFRY, which category of ownership no longer exists in the Republic of Croatia.
The full correct name of the user at that time was Komunalno podjetje Ajdovščina p.o. Goriška 25,
Ajdovščina.

The Seller's predecessor is the right of use of reference no. 1778/3 and reference no. 1778/4 acquired by payment
on the basis of sales contracts from 1976, and deposited with the competent court in 1980
under Z-436/77 and Z-759/80.
The listed legal successors of the registered holder of the right of use are the "Delimitation Agreement
in the execution of property and legal matters and obligations to the DSSS Business Organization
Construction trade company Ajdovščina" dated June 21, 1990, and the "Agreement on
land register status with dejanaski" from 06.04.1999; copies of which documents
The seller proves to the buyer his ex unregistered ownership and possession of the object of sale;
agreed to share the co-ownership, possession and manner of use of property code no. 1778/3, to the building and ID no
1778/4 in such a way that GOP d.d. belongs to 78.05%, i.e. 7805/10000 parts, and UTILITIES
it belongs to 21.95%, or 2195/10000 of the above-mentioned plots and buildings.
A division in kind was also carried out in such a way that it belongs to the Seller as exclusive ownership and possession
apartment no. 5 on the first floor with an area of ​​approx. 39 m2 according to the measurements at the time, and 2195/10000
part no. 1778/4, and 2195/10000 part no. 1778/3, with the restriction that the parking space at
the extreme southwestern part of par. no. 1778/3 with an area of ​​200 m2 (10x20m2) belongs to GOP. d.d.
as well as the remaining part of the building and land. In this way, the ownership and
possessory rights on the subject of sale are exercised to this day, as a result of which, from the construction of the building to this day,
the Seller, as the legal successor of the registered user (through the legal predecessor and personally)
is in independent, unhindered, legal and true possession of the subject of sale, which is
proved to the buyer by the above-mentioned documents.

GOP d.d. sold its ideal share of 7805/10000 shares, and
the real parts of the resort and land acquired through division, to the buyer from
Germany, who has been the owner of them and a co-owner in the building since then.
The method of using the associated land, with the restriction that the co-owner from Germany has the exclusive right to use the parking space in the extreme southwestern part of the plot cadastral number 1778/3 with an area of ​​200 m2 (10x20m), is agreed upon by the co-owners. The apartment that is the subject of this tender does not have separate electricity and water meters, but common meters for the entire building. The buyer therefore undertakes to determine with the co-owner the method of calculating and paying for the actual consumption of electricity and water. Exclusion of the seller's liability for legal defects: The seller's liability for legal defects is completely excluded. The Buyer is obliged to additionally declare in writing with the offer that he is familiar with and agrees with the current ownership, possession and land registry status of the subject of sale, that in the event of purchasing the subject of sale, he will arrange all actions and procedures necessary for registering the object in the land registers and cadastre, and registering his ownership of the subject of sale in the land registers and other public registers, at his own responsibility, risk and expense, and that he waives any claims against the Seller based on legal defects if, after concluding the purchase agreement, he is prevented from doing so for any reason. The Seller undertakes to provide the Buyer with all necessary assistance in this procedure at the Buyer's expense (delivery of additional documents at his disposal, conclusion of an Annex to this Agreement, etc.).

III. Initial sales price
The Seller obtained an estimate of the value of the subject of sale from an authorized court appraiser before the announcement of the Public Tender.

The apartment is equipped with standard equipment and furniture and is being sold as such.
The starting selling price for the subject of sale is €36,000.
The subject of sale will be available for viewing on Friday, June 27 and Saturday, June 28, 2025, from 10 a.m. to 2 p.m.

IV. Conditions of participation
The property is being sold on the basis of a public collection of written offers. Written offers for the purchase of the property must be sent:
